Oak Flat, an Arizona site sacred to the Apache, is at risk of becoming a copper mine. The Apache have been fighting to protect the site for some time. The 9th Circuit Court of Appeals is deciding whether to have the entire 11 member court re-hear the case, after a 3-judge review denied protections to the site.
While the site is unique, the 3-judge panel decided that using the site for mining was not an undue burden on the religious practices of the Apache.
